These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Webviewly ("Company," "we," "us," or "our") governing your access to and use of the Webviewly website and services available at webviewly.com (the "Service"). Webviewly is currently in private beta — helping website owners preview and prepare mobile app versions of their existing websites.

By accessing or using the Service, you confirm that you are at least 16 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Webviewly provides a platform that allows users to:

  • Preview how their existing website would appear as a mobile application.
  • Configure app settings including name, branding, and appearance.
  • Access guidance and tooling to prepare a mobile app for submission to app stores.

The Service is currently in private beta. Features, pricing, and availability may change without notice during this phase.

3. Waitlist and Early Access

By joining our waitlist, you:

  • Consent to receive email communications from Webviewly regarding product updates, launch announcements, and related offers.
  • Acknowledge that joining the waitlist does not guarantee access to the Service or any specific pricing.
  • May unsubscribe from communications at any time by clicking the unsubscribe link in any email or contacting us at hello@webviewly.com.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service to preview or convert websites that contain illegal, harmful, defamatory, obscene, or infringing content.
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service.
  • Use automated tools, bots, or scrapers to access the Service without prior written consent.
  • Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.
  • Attempt to gain unauthorized access to any part of the Service or its related systems.
  • Use the Service in a way that violates the intellectual property rights of any third party.
  • Misrepresent your identity or affiliation with any person or organization.

5. Intellectual Property

5.1 Our Property

The Service, including its design, text, graphics, software, and other content (excluding content you provide), is owned by or licensed to Webviewly and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without explicit written permission.

5.2 Your Content

You retain all ownership rights to your website and any content you provide to the Service. By using the Service, you grant us a limited, non-exclusive, royalty-free license to access and display your website URL for the purpose of providing the preview functionality.

You represent and warrant that you own or have the necessary rights to any website URL you submit, and that its use in our Service does not infringe on any third party's rights.

6. Pricing and Payment

During the private beta, the Service is offered free of charge. When paid plans become available:

  • Prices are stated in US dollars and are subject to change with notice.
  • Payments are processed through third-party payment providers. We do not store payment card information.
  • One-time fees are non-refundable except as required by applicable law or as stated in our refund policy.
  • Final pricing may vary based on app complexity, selected features, and applicable taxes.

7. Third-Party Services and Links

The demo feature loads third-party websites within an iframe for preview purposes. We do not endorse, control, or assume responsibility for any third-party website accessed through the Service. Some websites may block iframe embedding — this is a technical limitation outside our control and does not affect the quality of the final app.

We are not responsible for the availability, accuracy, or content of any third-party websites or services linked from or integrated with our Service.

8. Disclaimers and Limitation of Liability

8.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WEBVIEWLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WEBVIEWLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total cumulative liability to you for any claim arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. App Store Submission

Webviewly may provide guidance and tooling to assist with app store submissions. However:

  • We do not guarantee that your app will be approved by Apple App Store, Google Play Store, or any other platform.
  • App store review decisions are made solely by the respective platform operators.
  • You are responsible for ensuring your app complies with all applicable app store guidelines and policies.
  • We are not liable for any rejection, removal, or suspension of your app by any platform.

10. Indemnification

You agree to indemnify, defend, and hold harmless Webviewly and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • Your access to or use of the Service.
  • Your violation of these Terms.
  • Your violation of any third-party rights, including intellectual property or privacy rights.
  • Any content or websites you submit or make available through the Service.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

Upon termination, all rights and licenses granted to you will immediately cease. Provisions of these Terms that by their nature should survive termination will survive.
